# TikTok Compliance — Primary Sources

> What TikTok's actual Community Guidelines say about cannabis and fiction, how enforcement really works, and the live evidence that animated cannabis comedy reaches the For You feed.

## The Correction

Earlier guidance in this section said cannabis content is banned and that comedy had to avoid the experience of being high entirely. That was wrong in an important way, and the reason is worth stating: it was assembled from cannabis-marketing blogs, **most of which quote the superseded April 2024 guidelines.**

The current guidelines — **released 14 August 2025, effective 13 September 2025** — contain something the 2024 version did not.

  **Verbatim, from the ALLOWED list inside the drugs section of TikTok's Community Guidelines:**

  > "Fiction or art, unless it enables real-world access to regulated goods and services"

  This is not a vague artistic-expression gesture. It is an affirmative bulleted allowance sitting inside the *Regulated Goods and Services* policy, with exactly one stated exception.
</Note>

The same document carries "Fiction or art, unless…" clauses across roughly eight other policy sections. Fiction is a real, coded dimension in TikTok's taxonomy — not an accident of wording.

**For an animated series, this is the single most important fact on this page.**

## The Three Tiers

TikTok does not have one consequence. It has three, and conflating them is what produced the original bad guidance.

| **Remove**         | Content is deleted and a strike accrues       |
| **Age-Restrict**   | "We make it viewable only for adults" (18+)   |
| **FYF Ineligible** | "It won't be recommended in the For You feed" |

## The Actual Cannabis Rules

Verbatim from the current guidelines:

**Not Allowed**

* "Showing, promoting, or using drugs or other regulated substances recreationally. In some regions, this includes cannabis"
* "Trading, marketing, or providing access to … Alcohol, tobacco, drugs, or other regulated substances"
* "Providing instructions for making or using regulated substances"

**FYF Ineligible AND Age-Restricted** (both at once)

* "Showing or promoting cannabis or cannabis-related items, or adult tobacco use"

**Allowed**

* "Discussions of substance misuse or recovery"
* "Advocacy around public policies, such as drug or gun regulation"
* "Documentary or educational content that raises awareness about regulated goods and services"
* **"Fiction or art, unless it enables real-world access to regulated goods and services"**

<Warning>
  **The collision is unresolved and it is the real risk.** An animated character depicting cannabis use is simultaneously *"Fiction or art"* (allowed) and *"Showing cannabis"* (FYF-ineligible and age-restricted). **TikTok publishes no precedence rule.**

  That ambiguity — not an outright ban — is what we are actually navigating. And the best-case non-removal outcome under the cannabis line is adults-only plus no For You recommendation, which for a growing account is effectively reach death.

## Public Interest Exceptions

A separate platform-wide override on the Enforcement page:

> "We may allow content to remain on TikTok under public interest exceptions, including: Documentary · Educational · Medical or Scientific · Counterspeech · **Satirical** · **Artistic**"

Note precisely: **"Satirical" and "Artistic" are named. "Fictional" is not** — fiction is handled per-section instead. And TikTok is explicit that this is not a full pass:

> "Even if we allow content under a public interest exception, we might still: Make it ineligible for the FYF · Add a warning screen · Add a context label."

TikTok also offers a concrete, cheap mitigation, in its own words:

> "you might consider using features like captions, stickers, or voiceover to make it clear"

**Actionable:** on-screen framing that signals commentary, satire, or education is a documented mitigation. Our burned-in captions already do this structurally — we should make sure they lean into it.

## How Enforcement Actually Works

From TikTok's own Q1 2026 enforcement report:

| Proactive removal rate         | **99.3%**                              |
| Removed by automated detection | 178,014,154                            |
| Reinstated on review           | 8,838,710 — a **\~4.8% reversal rate** |

<Note>
  **You are facing a classifier, not a policy reader.** Roughly 99% of decisions are automated, they scan captions, on-screen text, spoken audio, and visuals, and **intent is not an input.** A perfectly compliant video can be flagged on signals alone. Appeals reverse about 5%.
</Note>

**Strikes expire after 90 days**, and drugs is **not** in the first-strike-permanent-ban tier (that is reserved for severe categories like violence and CSAM). The realistic failure mode is **accumulation**, not sudden death.

## The Live Evidence

This is what moved the conclusion. Stats pulled directly from TikTok's own page data, August 2026:

| **@cheechandchong**                                         | 7.6M followers, 1,362 videos                                                                      |
| **@thefreakbrothers** — Tubi's adult animated stoner series | **186 videos, 4,391 followers, \~187 likes per video**                                            |

**Animated cannabis comedy demonstrably reaches the For You feed.** A 2.9M-play video against a 1.4M follower base is very hard to achieve without FYF distribution. And @astudiodigital used "weed" in the caption outright, which directly contradicts the widespread agency claim that the word is an auto-flag.

### But read the craft carefully

The two winners share something specific:

* @daybreakanimations wrote **"gets too HIGH,"** not "weed," and hashtagged `#animationmeme #darkhumour` — **not** `#stonertok`.
* Both are **animation-identity accounts that happen to tell weed jokes** — not weed accounts that happen to animate.

<Warning>
  **@thefreakbrothers is the cautionary case and our closest structural analogue.** A legitimate media company's adult animated stoner series: 186 videos posted, 4,391 followers, roughly 187 likes per video.

  This may be suppression, or it may be low-effort clip-dumping and weak creative — the evidence does not distinguish. But it is the one example closest to what we are planning, and it has not worked. A cannabis-first animated account concentrates the classifier signal in a way an animation-first account does not.

## The Revealed Preference

Every major legal cannabis media brand has chosen to skip TikTok as an owned channel:

| Weedmaps   | `@weedmaps420` — 23 followers, **0 videos**. A parked handle    |

All maintain Instagram, YouTube, and X. Experienced cannabis marketing teams judged the account risk not worth it — though notably they made that call **before** the September 2025 guidelines added the fiction allowance.

**Paid is unambiguously closed.** TikTok Ads prohibits recreational drugs and paraphernalia with no legal-market carve-out and no certification path. Organic is the only route.

## What This Means For Our Scripts

    Depicting the *experience* of being high in animation is defensible under the fiction allowance. The Comedy Engine does not have to tiptoe around the subject the way the first draft did. Real terminology is fine — large education accounts use it openly.

    **Never enable real-world access.** That is the one stated limit on the fiction allowance, and it is absolute: no products for sale, no dispensary names, no brand names, no purchase links, no shop. Professor High still never consumes — he is the scientist, and it keeps us clear of the "showing cannabis" line entirely.

### The five operating rules

<Steps>
  <Step title="Position animation-first, not cannabis-first">
    The two accounts that work are animation brands telling weed jokes among other jokes. Bio, hashtags, and content mix should read as an animated comedy series that covers cannabis — not a cannabis account that animates. This is the single highest-leverage adjustment available.

  <Step title="Never enable real-world access">
    The one stated exception to the fiction allowance. No commerce, no brands, no dispensaries, no links.
  </Step>

  <Step title="Use TikTok's own stated mitigation">
    Captions, stickers, and voiceover that establish educational or satirical framing. Named verbatim on the Enforcement page as something that helps.
  </Step>

  <Step title="Instrument FYF eligibility from video one">
    TikTok **discloses per-video FYF-ineligibility in creator analytics.** Check it on every post. Do not infer suppression from view counts — measure it. This is the most valuable operational finding on this page.
  </Step>

  <Step title="Assume decay">
    Every documented workaround has a half-life. One creator watched a working euphemism go from millions of views to near-zero once copycats trained the classifier on it. Build the audience somewhere we own.
  </Step>

## Hashtag Policy

The `#cannabis` hashtag has had **access removed** — confirmed in peer-reviewed research (*Drug and Alcohol Review*, 2022): videos remain accessible but are no longer stored under the tag.

<Note>
  Our scripts already lead with `#terpenes`, `#cannabiseducation`, and `#cannabisscience` — the documented-safer clinical vocabulary. Two flagged tags (`#cannabiscommunity`, `#stonerhumor`) have been swapped out across all packs.

  **We do not use coded language.** "Magic broccoli" and similar euphemisms work until they are copied, and coyness undercuts an authority brand. Clinical vocabulary achieves the same result legitimately — and it is what the largest cannabis-science account on the platform uses.

## Disclosure Requirements

Two separate obligations that are easy to conflate:

| **TikTok AIGC label**            | Mandatory for AI-generated content. Properly labeled AI carries no algorithmic penalty; undisclosed runs warning → 7-day → 30-day → permanent ban |
| **TikTok commercial disclosure** | The **in-app disclosure toggle**, not just `#ad` in the caption. Undisclosed commercial content is **ineligible for the For You feed**            |
| **FTC**                          | Material connection disclosed **clearly and at the beginning**. `#ad` and `#sponsored` pass; **"collab," "ambassador," and "#spon" do not**       |
| **State law**                    | California requires ≥71.6% of audience reasonably expected to be 21+, and prohibits celebrity or lifestyle imagery appealing to minors            |
