Overview
These Terms of Use (“Terms”) govern your access to and use of the High IQ mobile application, the thisiswhyimhigh.com website, the High IQ API, and all related services (collectively, the “Services”) provided by This Is Why I’m High LLC (“we,” “us,” or “our”).
By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use our Services.

Age Requirement
You must be at least 21 years of age to use our Services. By creating an account or using any part of the Services, you represent and warrant that you are at least 21 years old.
- Legal compliance — Cannabis is restricted to adults 21 and older in all U.S. states where it is legal for recreational use
- Responsible platform — We are committed to keeping cannabis information and tools away from minors
- Industry standards — Age-gating is a standard practice across all cannabis technology platforms
We reserve the right to verify your age at any time and to suspend or terminate accounts that we reasonably believe belong to users under 21.
Account Registration
Creating an Account
To access most features of the Services, you must create an account. When creating an account, you agree to:
- Provide accurate and complete information
- Maintain the security of your account credentials
- Promptly update your information if it changes
- Accept responsibility for all activity that occurs under your account
- Notify us immediately of any unauthorized use of your account
Authentication
Account authentication is managed through our third-party provider, Clerk. You may sign in using Apple Sign-In or Google Sign-In. By using these authentication methods, you also agree to the respective terms of service of Apple and Google.
Account Termination
You may delete your account at any time through the app’s account settings or by contacting support@thisiswhyimhigh.com. Upon deletion:
- Your personal data will be removed within 30 days in accordance with our Privacy Policy
- Anonymized, aggregated data that cannot identify you may be retained
- Any content you contributed to public databases (e.g., label scan data) that has been anonymized will remain
We reserve the right to suspend or terminate your account if you violate these Terms, with or without notice.
Acceptable Use
Permitted Uses
You may use our Services to:
- Browse, search, and learn about cannabis strains and their properties
- Track your personal cannabis inventory, consumption, and spending
- Scan product labels to extract strain data
- Generate AI-powered reports on your consumption patterns
- Access educational content about cannabis, terpenes, and cannabinoids
- Use the High IQ API in accordance with the API documentation and rate limits
Prohibited Uses
You agree not to:
- Misrepresent your age — Creating an account if you are under 21 years of age
- Violate laws — Using the Services for any purpose that violates applicable local, state, national, or international law
- Distribute to minors — Sharing account access or Services content with anyone under 21
- Reverse engineer — Decompiling, disassembling, or reverse engineering any part of the Services
- Scrape or harvest — Using automated tools to scrape, crawl, or extract data from the Services beyond what the API explicitly permits
- Interfere with service — Attempting to disrupt, overload, or impair the functioning of the Services or their infrastructure
- Impersonate — Misrepresenting your identity or affiliation with any person or organization
- Commercial misuse — Reselling, sublicensing, or commercially exploiting the Services or their data without written authorization
- Circumvent restrictions — Attempting to bypass rate limits, authentication, or access controls
- Submit harmful content — Uploading malicious code, spam, or content that is illegal, threatening, abusive, or harassing
Intellectual Property
Our Intellectual Property
The Services, including all content, features, functionality, design, text, graphics, logos, icons, images, data compilations, software, and underlying technology, are owned by This Is Why I’m High LLC or its licensors and are protected by copyright, trademark, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Services for personal, non-commercial purposes in accordance with these Terms.
Strain Data
Strain information in our database is compiled from multiple public sources, research publications, and user contributions. While individual strain names are generally not proprietary:
- Our descriptions, classifications, and analyses of strains are original works protected by copyright
- The High Spectrum classification system and its methodology are proprietary
- Our database compilation and the selection, coordination, and arrangement of strain data are protected under copyright
User-Generated Content
By submitting content to the Services (including stash data, ratings, reviews, and label scan results), you:
- Retain ownership of your original content
- Grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display your content as necessary to operate and improve the Services
- Acknowledge that anonymized data derived from your contributions may be used to enhance the strain database
- Represent that your content does not infringe on any third party’s intellectual property rights
Trademarks
“High IQ,” “This Is Why I’m High,” “TIWIH,” the High IQ logo, and the High Spectrum family names are trademarks of This Is Why I’m High LLC. You may not use these trademarks without our prior written consent.
Disclaimer of Medical Advice
High IQ is not a medical service and does not provide medical advice.
- The Services provide educational and informational content about cannabis strains, their chemical profiles, and their commonly reported effects
- Nothing on the Services constitutes medical advice, diagnosis, or treatment recommendations
- Strain effect descriptions are based on aggregate user reports and published research, not clinical trials specific to you
- Individual responses to cannabis vary significantly based on tolerance, biology, consumption method, dosage, and other factors
- The AI features (reports, Professor High, label scanner) are informational tools, not medical devices or diagnostic instruments
- THC/CBD percentages and terpene data are provided as reported and may vary between batches, growers, and testing labs
If You Are a Medical Patient
If you use cannabis for medical purposes:
- Always consult your healthcare provider before making decisions about cannabis use based on information from our Services
- Do not substitute High IQ data for professional medical guidance
- Report any adverse effects to your healthcare provider immediately
- The Services are designed to supplement, not replace, the relationship between you and your healthcare providers
No Guarantees on Data Accuracy
While we strive for accuracy, we cannot guarantee that all strain data, effect descriptions, terpene profiles, or cannabinoid percentages are accurate, complete, or current. Cannabis is a natural product with inherent variability, and lab testing methodologies differ across facilities.
API Terms
If you access the High IQ API, the following additional terms apply:
Rate Limits
API access is subject to rate limiting as described in the API documentation. Exceeding rate limits may result in temporary or permanent suspension of API access.
Acceptable API Use
You may use the API to:
- Build applications that display strain information to end users
- Integrate strain data into your own cannabis-related products or services
- Conduct research using publicly available strain data
You may not use the API to:
- Build a competing strain database by systematically extracting all available data
- Resell raw API data without adding substantial value
- Exceed documented rate limits through any means
- Access non-public endpoints or data without authorization
Attribution
Applications that display data from the High IQ API should include visible attribution to High IQ as a data source, such as “Strain data powered by High IQ” or a similar notice.
Limitation of Liability
To the maximum extent permitted by applicable law:
- The Services are provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory
- We disclaim all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy
- We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services
- Our total liability for any claim arising from the Services shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater
- We are not responsible for decisions you make based on information provided by the Services, including but not limited to cannabis purchase, consumption, or medical decisions
Cannabis-Specific Disclaimers
- Cannabis remains illegal under U.S. federal law. It is your responsibility to understand and comply with the laws of your jurisdiction.
- We do not facilitate, encourage, or endorse the purchase, sale, or use of cannabis in any jurisdiction where it is illegal
- We are not responsible for any legal consequences you may face from cannabis use, possession, or purchase
- Strain availability, legality, and regulations vary by jurisdiction and change frequently. It is your responsibility to verify current laws in your area.
Indemnification
You agree to indemnify, defend, and hold harmless This Is Why I’m High LLC, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising from:
- Your use of the Services
- Your violation of these Terms
- Your violation of any applicable law or regulation
- Your infringement of any third party’s rights
- Any content you submit to the Services
Dispute Resolution
Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to conflict of law principles.
Before initiating formal dispute resolution, you agree to contact us at legal@thisiswhyimhigh.com and attempt to resolve the dispute informally for at least 30 days.
Arbitration
If informal resolution is unsuccessful, any dispute arising from these Terms or the Services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. Arbitration shall take place in the State of Texas.
Class Action Waiver
You agree to resolve disputes with us on an individual basis and waive any right to participate in a class action lawsuit or class-wide arbitration.
Exceptions
Nothing in this section prevents either party from seeking injunctive or other equitable relief in court for matters related to intellectual property infringement or unauthorized access to the Services.
Third-Party Services
The Services integrate with third-party services including Clerk (authentication), Convex (data storage), Supabase (database), and various AI providers. Your use of these Services may be subject to the respective third parties’ terms of service and privacy policies. We are not responsible for the practices or content of third-party services.
Modifications to Terms
We may modify these Terms at any time. When we make changes:
- We will update the “Last updated” date at the top of these Terms
- For material changes, we will provide notice through the app or via email at least 30 days before the changes take effect
- Your continued use of the Services after changes take effect constitutes acceptance of the modified Terms
- If you disagree with the changes, you must stop using the Services and delete your account
Severability
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and This Is Why I’m High LLC regarding your use of the Services, superseding any prior agreements.
